Photography Services Terms & Conditions
This document ("Agreement") sets forth the terms and conditions under which Hotwheelz Media LLC, a LLC (hereinafter referred to as "Company," or “we,” or “us”), provides photography services to clients for commercial purposes (hereinafter referred to as "Services"). Please carefully read this Agreement before proceeding with booking any Services.

1. Service Description:

Hotwheelz Photos offers creative, documentary, and editorial photography, including but not limited to headshots, product photos, automotive photography etc. We aim to deliver high-quality imagery that meets your creative needs while prioritizing accuracy, professionalism and efficiency.

2. Bookings:

  • All bookings must be made through our website at https://www.hotwheelz.photos/schedule or by contacting us through the form at https://www.hotwheelz.photos/contact

  • Deposit Policy: A non-refundable 50% deposit is required upon booking to secure the date and time of your photoshoot session. The remaining balance is due before final image delivery.

    • Payments: All payments must be made through Square.

3. Payment:

  • All final photos and edited images are delivered upon completion of payment for the full amount owed (excluding any applicable tax fees)

    • Full payment is due within 14 days of session with photos being taken.

  • Late payments: Failure to make payments within 14 days of photoshoot will result in late penalties as per our terms and conditions agreement.

3a Late Payments Policy:

  • Consequences: All outstanding invoices not paid within 14 days of the invoice date will be subject to a late payment fee of 20% of the total invoice. This late payment fee is in effect immediately.

  • Notification and Resolution: We’ll issue a reminder email on day 5 following the deadline for payment. You are responsible for notifying us, at your earliest convenience. Failure to notify us of non-payment will result in our ability to take further steps towards debt collection.

  • Contractual Agreement: You agree that this late fee policy is part and parcel of any contract you sign with Hotwheelz Media LLC. The fees listed above are non-negotiable.

4. Client Responsibilities:

  • The client is responsible for providing us with all necessary information and/or materials (models, props, or product) to create the best possible photos as requested.

    • Late Arrivals: Arriving after the scheduled time may affect photoshoot start time, leading to missed shots and possibly an adjustment in session length;

    • Changes: Significant alterations must be discussed and agreed upon with us before the shoot, ensuring minimal disruption and rescheduling are made for all parties involved.

5. Use of Photos & Rights:

  • All photos produced during our photoshoot sessions (including digital image files) are owned exclusively by Hotwheelz Media LLC.

  • All rights to reproduce, edit, adapt and display these photographs will be reserved. The client must obtain written consent from the photographer for any use beyond its intended purpose in their business/product marketing (subject to usage of images on social media/marketing materials).

6. Liability & Damage:

  • We will make every reasonable effort to prevent damage or loss during a photoshoot session; however, Hotwheelz Media LLC shall not be responsible for any damages caused by unforeseen circumstances beyond our control including weather and client negligence that impacts performance.

    • You are responsible for the safe handling of all your equipment in the event of a malfunction.

7. Cancellations & Reschedulings:

  • Cancellation Policy: Clients who cancel their booked session must do so with at least 48 hours of notice for shorter sessions or 96 hours notice for full day bookings. For cancellations less than 48 or 96 hours, the client will not receive their 50% deposit back.

    • Rescheduling: Reschedulings are subject to availability and must be made 48 or 96 hours in advance to minimize inconvenience for both parties.

8. Warranty:

  • Company guarantees that all images taken during our sessions will meet agreed-upon artistic standards, quality standards and deliver on expectations as discussed and set. If you have a valid complaint regarding the work done, please contact us within 14 days of final image delivery.

9. Agreement to Arbitrate:

  • This Agreement is governed by the laws of the State of Florida. Any dispute arising from or relating to this agreement shall be settled exclusively by binding arbitration in Lee County and all parties agree to accept the decision of a neutral arbitrator.

10. Amendments:

  • The Company reserves the right to revise its Terms & Conditions at any time without prior notice. Clients are responsible for regularly reviewing the updated terms.

11. Entire Agreement:

  • These Terms and Conditions constitute the complete agreement between you and Hotwheelz Photos of Hotwheelz Media LLC and supersede all prior or contemporaneous understandings, representations, and agreements, whether written or oral. If any provision of this agreement is held invalid or unenforceable, such provision shall be struck and the remaining provisions shall remain in full force and effect.
